This website is operated by the CASPAL brand of Ventinove srls. Throughout the site, the terms "we", "us" and "our" refer to CASPAL. CASPAL offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all the terms and conditions stated here.

By visiting our site and/ or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions.

No one under the age of 18 may purchase Goods. If you are under 18, please consult with an adult to make your purchase.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
We reserve the right to refuse service to anyone for any reason at any time.

Our contract with you

These terms and conditions apply: to the extent that the context permits, to you as a visitor to our website; and in any event to you as a purchaser or prospective purchaser of our Goods.

We will accept your order by confirming it to you by email. This is when our contract is formed. Our email will also confirm the details of your purchase and tell you when we will dispatch your order. We may change these terms from time to time. The terms that apply to you are those published here on our website on the day you order the Goods. If you purchase Goods from us in the future under any agreement that does not involve payment through our website, these terms will still apply.

Your account with us

You agree that you have provided and will continue to provide accurate and complete information about yourself. We require this information to supply you with the Goods you order. If you use the Website, you are responsible for maintaining the confidentiality of your account and password and for preventing any unauthorized person from using your account. You agree to accept responsibility for all activities that occur under your account and password. If you believe that your account has been used without your authorization, you should notify us immediately and log into your account and change your password.
You agree that any user name or email address selected by you does not interfere with the rights of any third party and has not been selected for any unlawful purpose, and that if we believe that such selection interferes with the rights of any third party or is selected for any unlawful purpose, we may suspend use of such name or email address and you will indemnify us for any claims or demands arising from your selection. We reserve the right to refuse you access to our Website at any time.

Our Products

We do our best to ensure that product images give you a good indication of what they look like. However, please note that images are for illustrative purposes only. Although we make every effort to display products accurately, because they are handmade, it is not always possible to accurately reflect the color, size, measurements and texture through digital displays on web browsers. Your products may therefore vary slightly from the images shown on our website.

Prices and Payment

We endeavour to keep the prices of our Goods up to date and accurate, although from time to time there may be inaccuracies or changes to the price. Price changes will not affect orders already placed. The prices of our Products are subject to change without notice. It is always possible that Products on our Website may be incorrectly priced. If this occurs, we will not dispatch your order until you have confirmed that you accept the new price or wish to cancel your order.
We will pay the bank charges of the receiving bank on payments to us. All other charges relating to payment in a currency other than Euro will be paid by you.
The price of a Product includes Italian VAT (where applicable).
The price of a Product does not include delivery charges.
Our delivery charges will be communicated to you during the checkout process, before you place your order. We accept all major credit and debit cards, which are clearly displayed at the point of payment. We also accept payments via PayPal. When you select the PayPal option at checkout, you will be directed to the PayPal site to review the amount, before completing the transaction and returning to our Website. You confirm that the payment method used is yours or that you have been specifically authorised by the card holder to use it.
All credit/debit cardholders are subject to validation checks and authorisation by the card issuer.
If your payment card issuer refuses to authorise payment to us, we will not be liable for any delay or failure to deliver.

Delivery

We aim to dispatch goods within 1-2 working days, however during peak periods dispatch may take a little longer.
We dispatch all orders via couriers and are happy to assist with any urgent delivery requests. Please ensure someone is present to accept and sign for the delivery. For made to order pieces, please allow 4-6 weeks for delivery. Please note that delivery times may vary from product to product due to the availability of the materials used.
If we think delivery will take longer than expected, we will let you know as soon as possible after your order has been placed.
We are currently unable to cover taxes and duties for orders to other destination countries, which will be your responsibility. This applies to all products, including made-to-order and bespoke items. Goods are shipped at our risk until signed for by you or someone else at the address you have given us. We will email you to let you know when we have dispatched your order, including tracking details.
We cannot be held responsible for delays caused by customs authorities in the destination country.

Returns & Cancellations

In the unlikely event that you are not satisfied with your purchase, you can return your order within 14 days of delivery for an exchange or full refund. Unfortunately, all returns received outside the returns window will be refused or issued with a credit note.
Items must be returned to us no later than 14 days from the date of delivery. Wherever possible, goods must be returned: with both goods and all packaging, in their original condition as far as possible; securely packaged; including our delivery note; marked "Return" (on the outer packaging); at your own risk and cost.
Please email our customer team before returning your goods at info@caspal.it. They will provide you with the returns form to complete and the details and address to send the goods to.
Please include the returns form to ensure we can process your return efficiently.
We aim to process returns within 3 working days of receipt, however during peak periods it may take a little longer. We are unable to cover the cost of returns.
When sending your return, please include the text "return shipment to origin" on the outside of the package to ensure the goods are not held up in customs. We cannot be held responsible for any incorrectly labelled returns.

In the event that the goods you receive are faulty: You must notify us by email at info@caspal.it, including full details of your order and the fault or other reason for the return, including photos. Goods must be returned as soon as a fault is discovered. Returned goods will be replaced or refunded at our discretion.

If you wish to cancel your order, please notify us by email at info@caspal.it or by phone as soon as possible. Unfortunately, once an order has been shipped, it cannot be cancelled and must be returned via our standard return method.

In certain circumstances and only if published credit is given to CASPAL (and the relevant CASPAL social handle), you may share promotional images found on caspal.it via social media and other channels. You may not adapt, alter or create a derivative work from any caspal.it content or images prior to sharing, without CASPAL's prior written permission.

Indemnity

You agree to indemnify, defend and hold us harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms and Conditions or your violation of any law or the rights of any other person.

Miscellaneous

We will communicate with you by email and you agree that email communications are contractually binding in the same manner as signed and dated documents sent by post.
Where we provide goods or services at no specific cost to you, then they are deemed to be provided free of charge and, accordingly, there is no contractual or other obligation on us in relation to such goods or services nor will we confer any benefit or obligation on any third party.
In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions. We are not liable for any breach of our obligations arising from causes beyond our reasonable control.
Our failure to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
In the event of a dispute arising out of or in connection with these terms or any contract between you and us, you agree to attempt to resolve the dispute by engaging in good faith with us in a mediation process before initiating arbitration or litigation. These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Italy.
This agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded.

Other Important Terms

We are currently offering 10% off your first order when you sign up to our newsletter. This discount code is only applicable for first time purchases. A unique welcome code will be sent directly to your email address after signing up.
Codes cannot be combined with other discounts.
The code can be applied to any product on our website, excluding Sale or products within the “Exclusivity” category. Refunds will take the discount into account. This code does not include shipping costs.
All credit notes, goodwill discounts and gift cards will be issued with an expiry date. Expiry dates are determined at our discretion unless otherwise specified. From time to time we may offer a free gift with purchase.
If you wish to return an order placed during a gift with purchase promotion, all items received must be returned.

Definitions In this contract:
"Carrier" means any person or company engaged by us to transport Goods from us to you.
"Consumer" means any natural person who, in relation to this contract, is acting for purposes outside his or her business.
"Our Website" means the entire computer hardware and software installation that is or supports our Website.
"Goods" means any of the items we offer for sale on our Website.
"Content" means any material in any form published on our Website by us.
